The Problem

We acted on behalf of a client who sustained injuries following an accident at work. The incident occurred during the course of their employment and resulted in our client suffering pain, discomfort, and a period of absence from work.

Despite the circumstances of the accident, liability was denied by the Defendant employer. This meant that our client faced uncertainty as to whether responsibility for the accident would be accepted and whether they would receive compensation for their injuries and losses.

Due to the denial of liability and the parties being unable to reach an early resolution, court proceedings were required to progress the matter and protect our client’s position.

The Solution

We gathered evidence in support of our client’s claim, including details regarding the circumstances of the accident, the working environment, and the impact of the injuries sustained. We also obtained independent medical evidence to assess the extent of our client’s injuries and prognosis.

Following the continued denial of liability, we issued court proceedings to move the matter forward and demonstrate our client’s commitment to pursuing the claim. This also allowed for the formal exchange of evidence and clarification of the Defendant’s position.

As the matter progressed, we engaged in negotiations with the Defendant, continuing to advise our client on the strengths of their claim and the risks associated with litigation.

The Outcome

Following negotiations after proceedings had been issued, we were able to secure a settlement prior to trial. This achieved a successful outcome for our client whilst avoiding the need for a contested final hearing.

The resolution allowed our client to receive compensation without having to endure the uncertainty, complexity, and time associated with a full trial.


Our client was pleased that the matter was resolved efficiently and that they were supported throughout what can often be a stressful litigation process.
