Nigel Walshe | Solicitor

Biography

Nigel holds an MA degree from Oxford University in Classics and Philosophy. After Oxford, he trained as a Solicitor and qualified as a Solicitor in 1978

In his long career, he has practised in Civil Litigation, Family Law and Criminal Law but from the 1990s has specialised in Civil Litigation.

He was the lead Solicitor in a large multi-party action on behalf of over 100 patients suing their former dentist in a case which came to be reported as Appleton and Others – v – Garrett [1997] 8 Med L.R .75 which was the first case to establish the right to aggravated damages in a clinical negligence claim.

He continues to practise in a wide range of Civil Litigation including contentious probate and estate litigation.

He has over many years campaigned against the policy of removing Legal Aid in large areas of Civil Litigation and campaigned against the closure of local Courts.

Approach

Nigel’s approach, based on the values formed in his early years as a Legal Aid Practitioner, is that of service to his clients and using the law to advance the interests of his clients. He is a strong believer that everyone has the right to access the law to achieve equality particularly in disputes with the State or with large organisations.

It is central to his approach to listen to his client’s account, to reflect that account faithfully on behalf of his client and to seek to achieve his client’s aims and objectives. It is also fundamental to his approach to give full explanations to his clients of the steps being taken, the options available and the Court procedures which are to be used, based on his belief that clients should be fully informed, be able to make their own decisions and that no legal procedure or concept is ever too difficult to explain.
